These Terms of Service (the “Terms”) govern your access to and use of the Kunavo platform, including the OpenAI-compatible API gateway at api.kunavo.com, the dashboard at kunavo.com, and any related services (the “Service”), provided by Kunavo (“Kunavo”, “we”, “us”).
This page is a plain-language summary draft. Final terms will be reviewed by counsel; nothing here constitutes legal advice.
1. Account & eligibility
You must be at least 18 years old and capable of entering into a binding contract to use the Service. You are responsible for keeping your account credentials secret and for all activity under your account.
2. Wallet, top-ups, refunds
The Service operates on a pre-paid wallet model. Top-ups are processed by Stripe and are non-refundable once consumed by API usage. Unused balance remains in your account without expiration. Account closure refunds remaining balance to your original payment method, less any payment processor fees.
3. Acceptable use
Your use of the Service is subject to our Acceptable Use Policy. We may suspend or terminate accounts that violate the AUP or applicable law, including upstream provider policies that we are bound to enforce.
4. API keys & rate limits
You are responsible for safeguarding your API keys. Compromised keys should be rotated immediately from the dashboard. We may apply per- account rate limits to protect platform stability. Rate limits are documented in the dashboard.
5. Content you submit; content we return
You retain ownership of the prompts and other content you submit. We process that content solely to provide the Service and forward it to the upstream model you select. Outputs generated by upstream models belong to you, subject to the upstream provider’s own terms. We do not train any model on your content.
6. Service availability & failover
We target 99.95% availability but the Service is provided “as is”. Multi-vendor hot failover is offered on a best- effort basis. Where an upstream provider experiences downtime, your request may be routed to an alternate provider with comparable capability; this routing is logged in the call detail view.
7. Fees & pricing
Per-call pricing for each model is published at kunavo.com/pricing and may change with notice. Catalog price changes never affect calls already billed.
8. Termination
Either party may terminate this agreement at any time. We may suspend your account for non-payment, AUP violations, or to comply with law. Remaining wallet balance is refunded per Section 2.
9. Limitation of liability
To the maximum extent permitted by law, Kunavo’s aggregate liability arising from or related to the Service shall not exceed the amount you paid Kunavo in the twelve months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
10. Governing law & disputes
These Terms are governed by the laws of the jurisdiction in which Kunavo is incorporated, without regard to conflict-of-laws principles. Disputes will be resolved by binding arbitration where permitted by law.
11. Changes
We may update these Terms. Material changes are notified by email and by a posted notice on the dashboard at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
